Can I claim my child this year on my taxes?

My ex(never married) share custody of our child together. The arrangement was just about 50% last year. He claimed our child the year before and I feel since we share custody evenly that i should be able to claim him this year. However he is a real jerk and i feel will give me a hard time if i try and talk to him about it. Should i just go ahead and claim my child and then try and work it our with the IRS? I am filing first this year. The court papers never comment on who can claim the child for taxes.thanks
